These terms apply to every survey, quote and installation or replacement job carried out by Sound Skylights Stockport. Please read them with your fixed written quote. If anything in a quote we have agreed with you in writing differs from these terms, the quote wins. Nothing here affects your legal rights as a consumer.
Section 1
Who we are and who these terms are for
Sound Skylights Stockport fits and replaces rooflights, roof windows, roof lanterns and sun tunnels in homes, and takes on small commercial jobs. We work from no public premises, and you can reach us by email at info@soundskylightsstockport.co.uk or on WhatsApp 07880 284133.
Our phone number is 0161 410 1861.
These terms are written mainly for homeowners buying as consumers. If you are buying for a business, some consumer rights described here, including the cancellation rights in section 5, do not apply to you, and we will agree any different terms with you in writing.
Section 2
The survey
The survey is free. Booking one places you under no duty to go ahead. We ask that an adult who can make decisions about the property is there, and that we can see the room and, where safe, the outside of the roof. If you are a tenant or own a flat, please tell us, because the owner's or freeholder's agreement may be needed before any work.
Section 3
Quotes and when a contract is made
Following the survey, a fixed written quote covering the work we have described comes to you. The price in it does not change unless the work changes, as set out in section 6. A quote can be accepted for the period we tell you when we send it; after that, please ask us to confirm it is still current.
A contract is made when you accept the quote in writing, for example by email, by WhatsApp or by signing it. Before you accept, we give you the information about cancellation that the law requires, and we then confirm the contract to you in writing.
Section 4
Paying for the work
How and when payment falls due is agreed in writing before work starts. If a deposit is asked for, we will tell you what it is for and when it is due. The balance is due when the work is complete, and we send you an invoice.
Please raise any concern about the finished work with us straight away, so we can look at it before the final payment is settled.
Section 5
Your right to cancel
Because we have no premises, our contracts with consumers are made at your home or at a distance, by email or WhatsApp. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you can cancel during the cancellation period, which generally ends 14 days after the day the contract is made. Where the contract also covers supplying a unit, the period can instead run from the day the goods come into your possession, and the cancellation information we give you says which applies. You do not have to give a reason.
To cancel, tell us clearly by email or WhatsApp. You can use the model cancellation form we send with the contract, but you do not have to. If you cancel in time, we refund any money you have paid, less any amount due for work you asked us to start early, no later than 14 days after you tell us.
If you want the work to start sooner
We will only start work during the cancellation period if you ask us to in writing. If you then cancel, you pay an amount in proportion to the work carried out up to the point you tell us, measured against the whole job. If the work is finished during the period at your request, and you have acknowledged that you will lose the right to cancel once it is complete, the right to cancel ends.
Units made to your measurements
Some rooflights are made to order for a particular opening. The law treats goods made to a customer's specification differently, and the right to cancel may not apply to such a unit. We will tell you before you accept the quote if that applies to your job.
Section 6
Changes to the work
You can ask to change the work at any time, and we will tell you in writing what the change means for the job and the price before going ahead. Sometimes something comes to light once work starts that could not reasonably be seen at the survey, such as timbers under the roof covering that are not fit to carry the new unit. If that happens, we stop that part of the work, explain what we have found and agree any change with you in writing before carrying on. We will not charge for extra work you have not agreed to.
Section 7
What we ask of you
- Give us safe access to the room and the roof on the agreed days.
- Clear the area under the work, or tell us if you would like help moving anything.
- Tell us about anything you know that affects the work, such as the house being listed, building work done before, or materials such as asbestos.
- Get any consent that only you can give, such as a freeholder's or landlord's.
- Keep children and pets away from the work area while we are working.
Section 8
What we are responsible for
We will carry out the work with reasonable care and skill, and supply units that are as described, of satisfactory quality and fit for their purpose, as the Consumer Rights Act 2015 requires. We will protect the room we work in, take away the waste from our work and leave the area tidy. Where the work is notifiable, we handle the Building Regulations notification with the council's building control team or a registered building control approver. Planning is looked at during the survey, and we tell you if an application is needed before work.
We will keep you informed about when work can go ahead. Weather and the delivery of made-to-order units can move dates, and if that happens we will tell you as soon as we know.
Section 9
Guarantees
Workmanship on the jobs we carry out carries our 10-year workmanship guarantee, as described on the guarantee page and in the document for your job. The unit itself carries its maker's guarantee, which differs between makers. Both sit alongside your legal rights and do not replace them.
Section 10
Our liability to you
If we break this contract or fail to use reasonable care and skill, we are responsible for loss or damage you suffer that is a foreseeable result. Loss is foreseeable if it is obvious it will happen or if both of us knew it might happen when the contract was made. We are not responsible for loss that was not foreseeable.
We do not exclude or limit our liability where it would be unlawful to do so. That includes death or personal injury caused by our negligence, fraud, and breach of your legal rights about the services and goods we supply. Because we supply homeowners for domestic use, we are not responsible for loss of business or loss of profit.
Section 11
If something goes wrong, and the law that applies
Please tell us first. Our complaints procedure explains how we deal with concerns and what you can do if we cannot settle one. These terms are governed by the law of England and Wales. You can bring a claim in the courts of England and Wales, or in the courts of the part of the UK where you live.
